For the import and export of goods and industrial setup in Punjab, a Punjab Pollution Control Board NOC is required, This document is used by the importer and exporter to get clearance from the Pollution Control Board for the import and export of products.

The Punjab Pollution Control Board NOC can be issued within two weeks of filing an application form, provided there are no legal issues or concerns with the product being imported or exported. It is not necessary to submit samples of the material being imported or exported. but it will help speed up the process if you do so.

Punjab Pollution Control Board NOC is a letter issued by the authority to the applicant to carry out projects and activities in the state of Punjab. It is an official document and thus it should be used with care while applying for any project in Punjab. In case of any violation of this noc, the responsible person can face legal action. The applicant should get the NOC from PPPCB before they apply for registration in any government department or office.

PPPCB NOC is necessary when the industrial activity involves generating waste and pollution which might affect the environment and public health. In that case, it is mandatory for them to take permission from the board before starting their business or project.

Types of NOCs that are necessary

In India, there are two types of NOCs necessary by the pollution control board in order to operate a business. The term “NOC” refers to a certificate that expresses the absence of any objections. These are licenses issued by the State Pollution Control Board to a business. These NOCs must be obtained prior to beginning a business. Various sorts of NOCs are required, including:

  • Consent to Establish (CTE) — This is a one-time approval from the state pollution control board that is required before starting a business. Consent to establish is granted with several factors of pollution control listed in law in mind. To acquire consent to establish, a company must meet all legal requirements, including all needed standards and documents.

Consent to operate (CTO) – This is the second level of consent that a company operating in India must obtain. Any level of pollution spread by the business necessitates getting this consent.

Registration Process for NOC

The process of getting PPPCB NOC is simple, as one can easily access online forms from their website and fill it up properly or you can consult with a legal advisory company coprseed. One should also attach all required documents to make sure that their application goes through smoothly. After that, the board will check and decide whether the issue or not.

The applicant can send PPPCB CTE  NOC to their desired department along with other registration documents to start their work (For CTO).

Business Activity Categories and Classification

Under the Air & Water Act, industries in the Red, Orange, and Green categories only need to apply for Consent to Establish (CTE) and Consent to Operate (CTO). White-category industries are exempt from obtaining consent to start and operate; instead, they must notify the Pollution Control Board (UPPCB) within 30 days after establishing a business with an undertaking.

Documents required by the pollution control board to get a pollution NOC certificate

The factory or industrial premise’s location plan or site plan.

  • For a proprietorship concern, these documents are Udyog aadhar or MSE certificate, partnership deed for a partnership firm, and article of association (AOA) and Memorandum of association (MOA) for a private limited company. A proprietor, partner, or managing partner, as the case may be, should self-attest these documents.
  • Land ownership documents such as a sale deed, a general power of attorney (GPA), or a lease deed or rent agreement.

  • Any previous Consent to Operate is granted to the entity’s compliance report.
  • Provided that the proposed location is in the designated Industrial area as notified and
  • That the current establishment plan is authorized. It should also show the revenue entries in detail.
  • Any other document required by local, state authorities.
